DID YOU KNOW: that words alone can constitute a crime? It’s true! PC 422 Criminal Threats is a charge that is comprised of words alone! Further, felony PC 422 is classified as a “serious” felony thereby making it a strike offense under the CA 3-strikes law.In light of the many recent tragedies, authorities and prosecutors are taking mere threat allegations more seriously. All of us at some point have said something we didn’t mean. It is very common amongst juveniles (teenagers). I would caution everyone to think before you speak (or post, email or text message)!
PC 422 does not require a death-threat, something as simple as “I’m gonna whoop your ...” is sufficient.
